Useful Information about LoanCheck

There are 5 main areas where consumer groups have voiced their concern.

1. Regulated loans (those under #25,000)

In the vast majority of cases the documentation needed for regulated loans  is not correctly completed in line with the Consumer Credit Act; this could render the loans unenforceable in law.

2. Loans in general

There are often significant differences between the way a loan repayment is actually calculated and the way that it should be. These differences may occur in the way interest is charged, how fines, penalties and charges are made to the account, and in the calculation of the redemption or pay-off figure. These differences result in the borrower being significantly overcharged.

3. Brokers

Many brokers acting for the borrower receive undisclosed commissions from lenders, and commissions from compulsory insurance policies. These commissions are all repayable to the borrower and may render the loan voidable or unenforceable, or at least subject to significant recalculation.

4. Repossession

In many cases of home repossession one or more of the previous factors may have arisen and the arrears may have been overstated. In fact, when calculated properly, there may have been no arrears at all, or the loan was voidable or unenforceable. In these cases, not only will there be a significant repayment due to borrowers but damages may also apply as a direct result of losing their home.

5. Payment Protection Insurance

Payment Protection Insurance is frequently mis-sold and is currently the subject of an Office of Fair Trading inquiry.
